These terms and conditions shall constitute a binding legal agreement on each user of this website, whether persons, legal entities, visitors or users, between you & Ecom Payments for Electronic Payments Company W.L.L.

You acknowledge that you have read the Terms and Conditions as amended from time to time and agreed to be bound by them, and Ecom payments Company shall have the right to amend them for any reason at any time it deems appropriate.

Your use of the Ecom website shall be considered an acknowledgment of your legal capacity to use the website and the services provided.

Ecom Service (LINKS): it authorizes the beneficiary to make a hyperlink and share it with the payer to collect money electronically.

Ecom Service (API): it authorizes the beneficiary to link his website to pay and collect money electronically.

Ecom Payments Company or related parties ask you for personal data, for example: project name, memorandum of association, commercial register, signature authorization, company headquarters address, personal address, bank account details data, e-mail and civil card. You also agree to provide any data or information to verify the identity of the beneficiary, and Ecom Company shall reserve the right to close the account or suspend or restrict your access to the services if it was not possible to obtain any of this information.

When you activate the WhatsApp service, you hereby agree to inform us of all correspondence and data available on the phone number connected to the WhatsApp platform.

Ecom Company shall not, in any way, bear civil or penal liability for the operations resulting from the local or international transportation carried out by the relevant parties according to the requests submitted by the merchants who are responsible for the delivery of products and services to the carrier.

You agree under these terms and conditions and authorize Ecom Company to use any or all information and data to disclose them to the relevant authorities of the State of Kuwait or by a court order or any external parties for the purposes of anti-money laundering verification, or any other purpose that Ecom Company deems necessary to determine the extent of compliance with applicable laws and regulations.

Ecom shall transfer those amounts collected from the services provided, and transfer and deposit them to the beneficiarys account within 2 working days from the date of depositing the payments.

Ecom shall have the right to delay payment/ deposit if the procedures are different, or electronic transactions should be reviewed, whether this review is by Ecom or based on instructions from the bank, K-Net, Visa or MasterCard, provided that the beneficiary shall be notified of the reasons for the delay. The beneficiary shall also be obligated to respond to any financial claims requested by Ecom, while bearing all the consequences that result from any illegal activity that takes place during the exploitation of the services provided.

When Ecom receives a request from the competent or related authorities to refund from KNET, MasterCard, or Visa Master within twenty-one days from the date of completion of any authorized transaction, provided to send a notice within twenty-one days or notify the beneficiary of the service by e-mail.

The Ecom Payments Services shall not participate, in any way, in the delivery, manufacturing, pricing, or delivery of the product to the customer, as this is the responsibility of the beneficiary of Ecom Payments services.

Ecom Payments may stop operating the website temporarily or permanently for any purpose at any time without entailing rights for the beneficiary of the services or any related parties.

Ecom Payments Service shall not be liable for any delay, or failure to deliver or ship the user (merchant) of the delivery of services or products.

The beneficiary of the service shall acknowledge of compensating Ecom Company for the expenses, fines, legal fees, investigation costs, and attorneys fees resulting from any illegal operations punishable by Kuwaiti law.

The user (payer) from whom you purchase goods or services using electronic money payment services shall not be considered a party to this Agreement. Any applicable terms between you and the user of the Services are independent of these Terms and Conditions.

To ensure that we are able to communicate with you electronically, you agree hereby to notify us immediately of any change in your email address.

The rights and obligations of the parties stipulated in the terms and conditions shall subject to what is in accordance with the provisions and regulations of the State of Kuwait.
